Why is a marital agreement important when getting remarried?

Whether you have been divorced or widowed, if you are getting married for a second time in Pennsylvania and either you or your partner have children from previous relationships, you should understand how a strong prenuptial agreement can help you, your future spouse and your children. Many people might often think about a prenup only as a tool used for planning an eventual divorce. However, that is far from the only benefit a prenup has to offer especially for a remarrying couple.

You and your partner likely have your own sets of assets and debts to bring to your new marriage. These assets may include family heirlooms that, regardless of their financial value, may have deep emotional value to each of your children. You may want to make sure that your grandmother’s dishes are passed on to your children, for example. This is one type of thing that can be specified in a prenup. 

When it comes to significant financial assets, you will want to determine whether those should go to your children first or to your spouse should they survive you. Your decision can be clearly stated in a marital contract. In this way, a prenup essentially aids your estate planning and may make managing your assets after you die less stressful and less adversarial for your family members.
