Father's child placed for adoption without his consent

A Pennsylvania father has brought a lawsuit concerning the adoption of his child without his permission.  While a judge denied his request for an amended paternity action to prevent the adoption from going forward, an appeals court ruled in his favor.  This means the lower court will once again have to reconsider this matter. 

The father is an Iraqi war veteran who was overseas when his child was born.  The mother of the child at first tried to hide the fact that she was pregnant from the father.  She later moved to another state where she gave the child up for adoption without consulting with the father.

The father alleged in his lawsuit that the lax adoption regulations in the other state allowed for women to travel there while placing children up for adoption without the consent of the father.  The father now would like to be granted full custody of the daughter.  His attorney stated that the appellate court decision might allow the father to at least enter into negotiations with the adoptive parents so that he can be provided with visitation rights.

Though this type of situation is hopefully rare, most child custody concerns do contain a degree of complexity.  Child custody matters frequently hedge upon decisions as to what is in the best interest of the children, but determining what that is can be difficult. Also, the desires and wishes of both parents do need to be considered.

Sometimes capable family law attorneys are required to intervene to make certain that all important issues are addressed when it comes to child custody cases.  Attorneys can provide legal options, negotiate with other parties and represent their clients when necessary.
